JUSTICE SHAILENDRA SINGH ORAL ORDER 2 18-11-2025 Mr. Alok Kumar Alok, learned counsel for the petitioners and Mr. Aditya Nath Jha, learned AC to SC-18 for the State-respondents, are present and they are heard. 2. The instant writ petition has been filed by the petitioners under Article 226 of the Constitution of India, with a Patna High Court CWJC No.17943 of 2025(2) dt.18-11-2025 3/4 prayer to direct the respondent authorities for correction in Chak Khatiyan in respect of Chak Khata No. 98, Chak Plot No. 296 corresponding to R.S. Khata No. 98 and R.S. Plot No. 296, Mauza-Sonapur, Thana No. 633, P.S.- Barsoi, Dist.- Katihar (Annexure-P/2) and further a direction for correction in Chak Khatiyan in respect of Chak Khata No. 98, Chak Plot No. 296 corresponding to R.S. Khata No. 98 and R.S. Plot No. 296, Mauza-Sonapur, Thana No. 633, P.S.-Barsoi, Dist.-Katihar (Annexure-P/3) as the petitioners’ land has wrongly been recorded in the said khatiyan in the names of Late Khairuddin and Late S.K. Mainuddin (father and grandfather of private respondents) respectively during Consolidation (Chak) Survey and for redressing the same, the petitioners approached the Director of Consolidation, Bihar, Patna, on 14.07.2025, where they were informed by the concerned office that the filing of such fresh cases in several districts, including Katihar, had been stopped, due to which the petitioners’ grievance could not have been redressed. 3. This Court is of the view that the issue raised by the petitioners is premature for consideration of this Court under its writ jurisdiction, however, the petitioners are given a liberty to file a fresh representation before the Director of Consolidation, Patna High Court CWJC No.17943 of 2025(2) dt.18-11-2025 4/4 Bihar, Patna, for redressal of their issue in the next four weeks from today. If the petitioners avail this liberty in the said period then the Director of Consolidation, Bihar, Patna, shall decide their representation according to merit, as per the provisions of law, within four weeks from the date of its filing.
