JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 18.10.2025 Through the medium of the instant petition, the petitioner has called in question the order dated 19.05.2025 passed by the learned Munsiff, Jammu, whereby the Court below has dismissed the application for condonation of delay along with the application for restoration of the suit, which was dismissed in default for non-prosecution/non-appearance of the parties, by invoking the powers under Article 226 of the Constitution of India. After arguing for a while, when confronted with the maintainability of the instant petition, learned counsel for the petitioner seeks withdrawal of the instant petition with liberty to seek appropriate remedy under law. His statement is taken on record. In view of the statement made by learned counsel for the petitioner, the instant petition is dismissed as withdrawn along with all connected application(s), with liberty as prayed for.
