For Petitioner : Ms.Shanas Fathima For Respondents : Mr.K.M.D.Muhilan Government Advocate (Crl.Side) O R D E R This Writ Petition has been filed to forbear the respondents from in any manner interfering with the affairs of the petitioner's club, SRV Recreation Club Vellakoil located at SF 51/2, Door No.2/846A, Koolipalayam Nal Road, Sarkar Periyapalayam, Tirupur-641607, its members and the facilities provided for playing various games including the game of playing rummy not involving any element of gambling. 2. The learned counsel for the petitioner submits that the petitioner's club was registered on 04.10.2021, under the Tamilnadu 2/6 https://www.mhc.tn.gov.in/judis W.P.No.35754 of 2024 Societies Registration Act, 1975 with the Registrar of Societies, Tiruppur vide SRG/Thiruppur/93/2021. He further submits that initially the club was operating from S.F.No.1098, Sathipalayam Post, Kulathottam, Vellakoil, Senpathipalayam, Kangeyam Taluk, Tiruppur District. Now, the petitioner's club has been shifted to the present address at Sarkar Palayam through lease agreement with one Chinnasamy. While being so, the third respondent causing disturbance to the activities of petitioner's club. The petitioner's club is permitted to play many indoor and outdoor games such as carrom, kabadi, badminton etc are played a the club. Rummy game is one of the indoor games played without any monetary benefit or gambling. 3. The learned counsel for the petitioner also submits that as per the direction of this Court vide order dated 25.10.2021 in W.P.No.22620 of 2021, the present premise of the club is also equipped with CC T.V cameras and the club is maintaining the attendance register of the members visiting the club. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that now the petitioner's club has been shifted to the present address and that the respondent police has not caused any obstacle as stated by the learned counsel for the petitioner. 5. Heard the learned counsel for the petitioner as well as the learned Government Advocate (Crl.Side) and perused the materials available on record. 6. Considering that facts and circumstances of the case, the third respondent is at liberty to conduct surprise check without affecting normal functioning of the club activities and also take action if any illegal activities are found to be encouraged in the club. 7. With the above direction, this Writ petition is disposed of. No costs.
