JUSTICE RAJEEV RANJAN PRASAD) 2 17-11-2025 Heard learned counsel for the petitioner and learned AC to SC-22 for the State. 2. The petitioner is seeking release of the vehicle (Bajaj Maxima Tempo) bearing Registration No. BR31PB1619, Engine No. A2XWPF86839, Chassis No. MD2B17AX5PWF84832, which has been seized in connection with Desari P.S. Case No. 400 of 2024. 3. It is alleged that total 110 liters of illicit country made liquor was recovered from the polybag kept on the passenger seat. 4. Learned counsel for the petitioner submits that till date confiscation proceeding has not been initiated in this case. It is his further submission that he had no concern with the Patna High Court CWJC No.15271 of 2025(2) dt.17-11-2025 2/2 alleged occurrence and the said tempo is the only source of income for the livelihood of the petitioner. 5. Learned counsel for the State submits that 110 liters of illicit liquor has been found on the tempo of the petitioner. So far as initiation of confiscation proceeding is concerned, it is not known whether any proceeding has been initiated or not. 6. Having regard to the entire facts and circumstances of the case, we grant liberty to petitioner to appear before the District Magistrate, Vaishali within two weeks from today and file an appropriate application for release of the vehicle. The District Magistrate, Vaishali shall positively pass an appropriate order in the matter of release of the vehicle on such terms and conditions as he may deem just and proper and in accordance with law. In any case, such order be passed within a period of four weeks from the date of filing of the application. 7.
