Learned counsel for the applicant submits that due to inadvertence the prayer has been wrongly mentioned. Learned counsel for the applicant is permitted to correct the same during the course of hearing. Sri Om Prakash, learned counsel for the applicants and Sri Karunakar Singh, learned A.G.A. for the State are present. The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita has been filed to quash the order dated 30.08.2025 passed by Additional Chief Judicial Magistrate, Hamirpur in Complaint Case No. 2564 of 2023, under Sections 304, 328 of I.P.C. read with Section 34 of I.P.C., whereby non-bailable warrant has been issued against the applicants. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
