By means of this writ petition, petitioner has sought the following relief:- (i) To issue an appropriate writ, order or direction issue and directing the respondents to finalize and grant the residential lease to the petitioner under the Government Order no. 150/1/85(24)/RA-6 Dated 09.10.1987 for which the lease file is pending with the authority. (ii) To issue an appropriate writ, order or direction and set aside the effect of letter number 577/R-KA/2022 dated 1st July 2022 issued by the Tehsildar, Nainital and further Direct the respondent to continue with the allotment process and grant residential lease to the petitioner in compliance of Government Order no. 150/185(24)RA-6 Date 09.10.1987 and incentive under National Compaign for Family Planning. 4. Learned counsel for the petitioner submits that petitioner be permitted to make fresh representation to District Magistrate, Nainital, who may be directed to examine petitioner’s claim. 5. The writ petition is, accordingly, disposed of by permitting petitioner to make fresh representation to District Magistrate, Nainital, within two weeks from today. If petitioner makes representation within stipulated time, the 2025:UHC:7578 same shall be considered and decided, as per law, within four months thereafter. It goes without saying that District Magistrate shall call a report from the concerned Tehsil Authorities, before taking any decision.
