G.P. for Agriculture The Court made the following: 2 W.P.No.827 of 2015 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “...to pass order or orders more particularly one in the nature of writ of mandamus by declaring the action of the respondents in not paying the payments of total due amount of Rs.13,73,609/- to the petitioner in spite of repeated remainders is illegal, arbitrary and unconstitutional and consequently direct the respondents to forthwith pay the outstanding total amount of Rs.13,73,609/- to the petitioner and pass...” 02. There is no representation to the petitioner today and on 16.07.2025 as well. 03. On 16.07.2025, Sri T. Raghu, learned Assistant Government Pleader for Agriculture placed on record instructions of Director of Agriculture, Andhra Pradesh addressed to the Government Pleader, Agriculture and Co-operation vide Lr.No.PB/1/2025, dated 16.07.2025, which reads as follows: “It is further to submit that, the petitioner has claimed that, the dues are pending from Krishna, West Godavari, Prakasam, Nellore, East Godavari, Guntur, Anantapur, Chittoor, Kurnool and Kadapa districts. The respondents further affirm that, there are no willful lapses, and nor even an iota of disobedience on the part of the respondents for the delay occurred in clearing the pending dues of the petitioner as the petitioner has not yet approached the respondents. Expressing a great degree of respect and honor towards the High Court, the 1st and 2nd respondents pray that, the High Court may be pleased to sanction 4-6 weeks' time to facilitate 3 W.P.No.827 of 2015 the respondents for verifying the records available with the districts so as to obtain necessary approvals from the government to clear the pending dues of the petitioner at the earliest.” 04. As such, the learned Assistant Government Pleader for Agriculture requested time. Therefore, the matter was adjourned to 18.08.2025. 05. Today, the learned Assistant Government Pleader for Agriculture placed on record a copy of the further written instructions of the respondent No.2 addressed to the Government Pleader, Agriculture and Co-operation vide Lr.No.PB(1)/2025, dated 18.08.2025, which reads as follows: “…It It is further to submit that the petitioner has claimed that the dues are pending from Krishna, West Godavari, Prakasam, Nellore East, Godavari, Guntur, Anantapur, Chittoor, Kumool and Kadapa Districts. It is submitted that, the total subsidy as admitted by the District J.D.As. as due to be paid to the petitioner was Rs.8,39,108/- only against the claim of Rs.13,73,609/-claimed by the petitioner. The respondents further affirm that, there are no willful lapses, and nor even an iota of disobedience on the part of the respondents for the delay occurred in clearing the pending dues of the petitioner. Expressing a great degree of respect and honor towards the High Court, the 1st and 2nd respondents pray that the High Court may be pleased to sanction 3-4 weeks' time to facilitate the respondents to obtain necessary budget for Rs Rs.8,39,108/- from the Finance Department to clear the pending dues of the petitioner at the earliest.” 4 W.P.No.827 of 2015 06. In view of the above instructions, the writ petition is disposed of giving liberty to the petitioner to approach the appropriate authority with supporting documents in respect of the claim prayed in the writ petition.
