1. The matter is taken up through hybrid mode.
2. Heard Mr. R.N. Prusty, learned counsel for the Petitioner and Mr. J. Khandayat Ray, learned ASC for State-Opposite Parties.
3. It is submitted that the authorities have proceeded against the Petitioner for his eviction without granting any opportunity of hearing to him. In this regard the Tahasildar has issued notice in the name of late father of the Petitioner. It is further submitted that Civil Suit No.281 of 2019 is pending relating to the right of the Petitioner to possess the suit property.
4. Accordingly the writ petition is disposed of at the stage of admission, with a direction to the Tahasildar, Athagarh (O.P.No.4) to grant an opportunity of hearing to the Petitioner and decide the question of eviction, in accordance with law, within a period of two months from the date of receipt of certified copy of this order along with a copy of the writ petition. Till such decision is taken by the Tahasildar, the Petitioner may not be evicted from the case land.
