Prayer in this petition, filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, is for grant of regular bail to the petitioner in FIR No. 98 dated 01.05.2025, registered under Sections 305, 331(4) and 317(2) of BNS, 2023 at Police Station Cheeka, District Kaithal. 2. The aforementioned FIR was registered on the basis of a written complaint filed by complainant Lal Singh alleging that on the night of 30.04.2025, some unknown persons had stolen gold jewelry weighing 10 tolas as well as an amount of Rs.1 Lakh from his house. After registration of FIR, investigation proceedings were initiated. During investigation, the petitioner was arrested on 14.05.2025. Recovery of some of the stolen properties was effected from him. On the basis of his disclosure, co-accused were nominated as such and were arrested. Some of the stolen properties were also recovered from them. Investigation now stands completed. It is argued by learned counsel for the petitioner that he has been falsely implicated in this case. He is in custody since 14.05.2025. A false recovery has been planted upon him. The subject offences are triable by Magistrate. His further incarceration would not serve any useful purpose. Trial will take considerable time to conclude. Therefore, it is urged that the petition deserves to be allowed and the petitioner deserves to be released on regular bail. 4. Per contra, learned State counsel has argued that the allegations against the petitioner are serious and specific. He is a habitual offender as he is involved in several other cases of similar nature. There are chances of his absconding or committing similar offences, if released on bail. Hence, it is urged that the petition is liable to be dismissed. 5. I have heard learned counsel for the parties at considerable length and have also perused the material placed on record. 6. The petitioner is alleged to have committed theft of gold jewelries as well as cash amount of Rs.1 Lakh from the house of the complainant on the night of 30.04.2025. He was arrested on 14.05.2025 and some of the stolen properties had been recovered from him. Investigation has since been completed. The trial has commenced but the conclusion of the same would obviously take considerable time. No doubt, the petitioner is involved in some other cases of similar nature as well but that alone cannot be made a ground for denying him the concession of bail in the given circumstances. Keeping in view the aforesaid facts, I am of the considered opinion that no useful purpose would be served by keeping him in custody anymore. Accordingly, the present petition is allowed.
