HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34182 of 2025 Court No. - 33 HON'BLE ROHIT RANJAN AGARWAL, J.
1. Heard learned counsel for petitioners and learned Standing Counsel for the State.
2. The sole question involved in the present writ petition is that petitioners, who were granted the lease for pond, has been determined by the orders passed by the Sub Divisional Officer concerned which has been put to challenge in the revision before the Commissioner, which has been dismissed.
3. The Rule 57 (12) of U.P. Revenue Code Rules, 2016 clearly prohibits any lease beyond 5 years. The relevant rule is extracted hereasunder;
"57. Lease of Tanks (12) Every such lease shall be executed for a period of five years and the same shall not be renewed or extended."
4. The prayer made by petitioner for extending the lease beyond the period for which it was granted cannot be considered because Rule 57 (12) of U.P. Revenue Code Rules, 2016 clearly debars any further renewal or extension of lease.
5. Writ petition is misconceived and stands dismissed. September 25, 2025 Shekhar Versus Counsel for Petitioner(s) : Pankaj Kumar Singh Counsel for Respondent(s) : Ajay Vikram Singh, C.S.C.
