The petitioners claim that they have filed suit in OS No.150 of 2023, on the file of Junior Civil Judge, Venkatagiri against respondent Nos.5 to 7 seeking partition of the suit schedule property. It is further case of the petitioners that pending the suit, the 7th respondent herein made application seeking to mutate his name in revenue records over an extent of Ac.5-06 cents in Sy.No.1245-2 of Korumitta Village, Rapur Mandal, SPSR Nellore District along with other properties. 2. Apprehending that the 4th respondent may consider the application filed by the 7th respondent, petitioner approached this Court seeking a direction not to mutate the name of 7th respondent pending suit in OS No.150 of 2023, on the file of Junior Civil Judge, Venkatagiri. 3. On the other hand, the Government Pleader for Revenue placed instructions dated 06.03.2025 furnished by the 4th respondent. On perusal of the said instructions, it is categorically stated that initially land admeasuring an extent of Ac.5-06 cents Sy.No.1245-2 of Korumitta Village, Rapur Mandal, SPSR Nellore was assigned in favour of Pattan Mahaboob Bee, W/o.Pattan Rasulkhan and her name is mutated in revenue records. The instructions further read that the said Pattan Mohaboob Bee was also issued pattadar pass book. It is further stated in the instructions that there is a civil suit pending between the parties. Further the 4th respondent has stated that, appropriate action will be initiated as per the Judgment that is going to be passed in the said suit. 4. The said instructions dated 06.03.2025 furnished by the 4th respondent is placed on record. 5. Accordingly, the writ petition is disposed of directing the parties to agitate their rights over the subject lands in pending suit. There shall be no order as to costs.
