Order on Board 21/02/2025
1. By the present writ petition, the petitioners are seeking a direction towards the respondent authorities/Collector to decide the case No.2024110100001/ B-121/ 2024-25 while deciding the application dated 21/01/2025 (Annexure P/4).
2.
Learned counsel appearing for the petitioners submits that the petitioner has approached the Collector by filing an appeal dated 24/01/2024 (Annexure P/1) to inquire about the illegal mutation made by the Tahsildar, Baikunthpur, questioning the order of mutation and also seeking an enquiry by a high power committee.
3.
Learned counsel appearing for the State by referring the ordersheet dated 06/11/2024 submits that the Collector has already taken cognizance on the application moved by the petitioner and by seeking a report from the enquiry Committee the matter has been fixed by the Collector on 20/02/2025 hence there is no need for any direction towards the Collector as he has already taken cognizance on the application moved by the
3 / 3 petitioner and after proceeding in the matter, it has been fixed for the enquiry report.
4. I have heard learned counsel for the parties and perused the documents as well as the ordersheet of the Collector.
5. From perusal of ordersheet dated 06/11/2024 to 23/01/2025, it appears that the Collector has already taken cognizance on the application moved by the petitioner and the Collector by directing the Superintendent- Land Record asked for a report from the Committee constituted by him and is proceeding on the application moved by the petitioner. Thus, there is no need to direct the Collector to proceed in the matter.
6. Accordingly, the present writ petition appears to be premature, deserves to be and is hereby dismissed.
