learned counsel appearing on behalf of the complainant and perused the record. 2-The instant Criminal Misc. Anticipatory Bail Application under Section 482 B.N.S.S. has been preferred by the applicant after rejection of her anticipatory bail application by the order dated 26.08.2025 passed by learned Additional District and Session Judge/F.T.C.-I, Deoria seeking Anticipatory Bail in Case Crime No. 216 of 2025, under Sections 80, 85 B.N.S. and Sections 3/4 D.P. Act, Police Station Kotwali Salempur, District Deoria during the pendency of the investigation. 3-As per the prosecution case in brief, complainant Kamlesh Rajbhar, who is father of the deceased got a first information report lodged on 09.07.2025 against Upendra Rajbhar, Komal Rajbhar, Ramavati Devi, Jaanki, Nandini and Chandni who are husband, father-in-law, mother-in-law and sisters-in-law of the deceased respectively stating inter-alia that the marriage of his daughter was solemnized with Upendra Rajbhar about four years back. In the said marriage, sufficient dowry was given but his daughter was being harassed in her matrimonial home by her in-laws. Versus Counsel for Applicant(s) : Akhilesh Singh, Yogendra Yadav Counsel for Opposite Party(s) : G.A., Kamlesh Singh Ramawati Devi .....Applicant(s) State of U.P. .....Opposite Party(s)
4-The main substratum of argument of learned counsel for the applicant is that the applicant is mother-in-law of the deceased and she has been falsely implicated in this case. Co-accused Komal Rajbhar, father-in-law of the deceased has been granted anticipatory bail by the co-ordinate Bench of this Court vide order dated 18.09.2025 passed in Criminal Misc. Anticipatory Bail Application under Section 482 BNSS No. 7655, therefore, the applicant is also entitled to get anticipatory bail on the ground of parity. 5-Learned Additional Government Advocate as well as learned counsel for the complainant opposed the prayer for granting anticipatory bail to the applicant in the light of the F.I.R. but could not dispute the factum of the case as argued on behalf of the applicant. 6-Having heard the submissions of learned counsel for the parties and perusing the record, I find that no specific role has been attributed to the present applicant and co-accused Komal Rajbhar, under similar accusation, has been granted anticipatory bail as noted above.
The case of present applicant stands on similar footing to that of co-accused Komal Rajbhar, therefore, the applicant has made out a prima-facie case for anticipatory bail on the ground of parity. 7-Accordingly, it is directed that in the event of arrest of the applicant Ramawati Devi involved in the aforesaid case shall be released on anticipatory bail on her furnishing a personal bond of Rs. 25,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station concerned till the submission of police report, if any, under Section 193(3) BNSS with the following conditions :- (a) The applicant shall make himself available for interrogation by a police officer as and when required. (b) The applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the
facts of the case so as to dissuade him from disclosing such facts to the court or to any police officer or tamper with the evidence. (c) The applicant shall not leave India without the previous permission of the court.
NABAIL No. 7929 of 2025 2
(d) In default of any of the conditions mentioned above or in case it is found that applicant has obtained this order concealing any material
facts, the investigating officers shall be at liberty to file appropriate application for cancellation of anticipatory bail granted to the applicant. 8-With the aforesaid directions, this anticipatory bail application is allowed.
