Vimla AIR 1961 (SC) 1299, the revision petition filed by the petitioner (the defendant before the trial Court) is not maintainable against the order passed by the trial Court refusing to direct the plaintiff to pay ad valorem Court fee because basically the issue of Court fee relates to the Court and the plaintiff. 2. He submits that the notice of motion was issued only to explore the possibility of settlement. 3. This revision petition is pending for the last 4 years. 4. There has been no development so far. 5. The Court has been informed that the parties to this litigation are involved in multiple litigations, which are pending before the Courts below.
