Case No. 44 of 2024, registered under Sections 8, 20(b) (ii) (c), 22(c) of NDPS Act, pending in the Court of learned Sessions Judge, Gumla. Bail application of the petitioner was earlier rejected by this court vide B.A. No. 9397 of 2024 by order dated 14.11.2024. On 07.06.2024, Ghaghra police on the basis of confidential information seized a Hyundai Aura Car and on search 108 Kgs. of cannabis were recovered from the said vehicle. The petitioner was apprehended while travelling on the said vehicle. It was submitted that similarly situated co-accused has been granted bail by a co-ordinate bench of this court. Regard being had to the facts and circumstance of the case and considering the fact that commercial quantity of cannabis was recovered from the joint possession of the petitioner and co- accused persons; I am not inclined to enlarge the petitioner on bail.
