Heard Sri Ritesh Singh, learned counsel for the applicant as well as Sri Sunil Kumar, learned A.G.A. for the State and perused the material placed on record. 3. The present bail application has been filed on behalf of applicant- Vinod to enlarged him on bail in Case Crime No.853 of 2021, under Sections 376AB I.P.C. and 5/6 POCSO Act, Police Station- Jalalabad, District- Shahjahanpur, during the pendency of trial. 4. This is the second bail application on behalf of the applicant. The first bail application was dismissed by the Co-ordinate Bench of this Court vide order dated 6.9.2024 passed in Criminal Misc. Bail Application No.7729 of 2023 for want of prosecution and it was not on merits. 5. After hearing learned counsel for the parties, taking into consideration that there are injuries sustained by the victim and already three witnesses of fact have been examined coupled by the fact that the FIR is prompt instituted within five hours and the trial is going on, I do not find it a fit case for grant of bail to the applicant. 6. The present bail application is hereby found devoid of merits and is accordingly rejected. 7. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
