CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 2 04-11-2025 Heard the parties.
2. The petitioner, in the present writ petition, prays for the following relief:-
“(a) The official respondents be commanded/directed toinitiate appropriate legal proceeding under section 144 Cr. P. C.
Patna High Court CWJC No.20728 of 2018(2) dt.04-11-2025 2/3 or under any appropriate section restraining the private respondents from disturbing the peaceful possession of the petitioner over Plot no. 195 under Khata no. 37, Area 50 decimal situated in Village- Salempur, P. S. Karai Parsurai, District-Nalanda which has been allotted to the predecessor of the petitioner in a partition Suit. (b) The official respondents namely respondent nos. 1 to 7 be commanded to provide due protection so that private respondent nos. 8 to 11 may not commit any mischief as they are anti- social and terror type persons and the petitioner is living in fear. (c) The official respondents be
directed to take due legal steps against private respondents if they forcibly try to make rasta on the raiyati land to the petitioner which has neither been acquired nor the petitioner or his predecessor have in any manner donated anyportion of the said land in which a bell dug up by petitioner's predecessor also exists. (d) By an ad interim measure the respondents be restrained from making any mischief on the raiyati land of the petitioner during the pendency of the writ application. (e) Any other relief or relief's which the petitioner be found entitled to be granted to him.”
3. Learned counsel for the petitioner prays for and
Patna High Court CWJC No.20728 of 2018(2) dt.04-11-2025 3/3 allowed to implead the Sub Divisional Magistrate, Hilsa, District – Nalanda as party respondent No. 12 during the course of the day.
4. After some argument, learned counsel for the petitioner submit that he shall be approaching the newly added respondent i.e. Sub Divisional Magistrate, Hilsa, District – Nalanda (Respondent No. 12) in the next two weeks.
5. Learned counsel for the State submit that if such petition is preferred after putting all the concerned parties to notice, the same shall be come to its logical conclusion.
6. In that background, the present writ petition stands
disposed of allowing the petitioner to approach the newly added respondent No. 12 in two weeks who shall after hearing all the parties, after putting all the parties to notice, take the matter to its logical conclusion.
