For the Respondents: Mr. Rajan Kahol, Mr. Vishal Panwar and Mr. B.C.Verma, Additional Advocate Generals, with Mr. Ravi Chauhan, Deputy Advocate General. ____________________________________________________ Sandeep Sharma, Judge(oral): Petitioner herein who at present is working as Statistical Assistant in the Office of Child Development Project Officer, Pangi at Killar, District Chamba, H.P., has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation Annexure P-2, whereby prayer has been made for transfer of the petitioner from present place of posting to some other station on account of his having completed normal tenure in the hard area i.e. two winters and three summers. 2. Having regard to the nature of prayer made in the instant petition and order proposed to be passed, this Court sees no 1Whether the reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:8035 necessity to call for the reply on behalf of the respondents, who are otherwise represented by Mr. Vishal Panwar, learned Additional Advocate General. Mr. Panwar states that representation, if not already decided shall be decided expeditiously. 3. Precisely, grouse of the petitioner as has been highlighted in the petition and further canvassed by Mr. Ashok Kumar, learned counsel for the petitioner is that though petitioner has already completed his normal tenure of posting in hard area, yet he is not being transferred to soft area or one of the station of his choice. Since there is a provision in the transfer policy framed by the Government of Himachal Pradesh from time to time, to transfer an employee from hard area to soft area after his/her having completed the normal tenure of posting, this Court sees no impediment in accepting the innocuous prayer made by the petitioner. 4. Consequently, in view of the above, this Court without going into the merits of the case, deems it fit to dispose of the present petition with a direction to the respondents to consider and decide the pending representation 20.01.2025 (Annexure P-2) of the petitioner expeditiously, preferably within a period of three weeks. 5. Ordered accordingly. Needless to say, authority concerned, while doing needful in terms of instant order, shall afford an opportunity of hearing to the petitioner and pass a speaking order 3 2025:HHC:8035 thereupon, taking note of the transfer policy as detailed hereinabove. Liberty is also reserved to the petitioner to file appropriate proceedings in appropriate court of law, if he still remains aggrieved.
