Ms. Manisha Rana Singh, Deputy Advocate General for the State. Hon’ble Ravindra Maithani, J. (Oral) The applicant is in judicial custody in Special Sessions Trial No. 01 of 2022, State Vs. Amandeep Singh and others, under Section 3(1) of the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, pending in the court of 2nd Additional Sessions Judge/Special Judge (Gangsters Act), Rudrapur, District Udham Singh Nagar (“the case”), which is based on FIR No.136 of 2021, Police Station, Khatima, District Udham Singh Nagar. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the applicant would submit that the applicant has already been granted bail in the case; he was appearing in the trial, but in search of job, he has to go out from his place; he was just 18 years 2 of age when the case was registered against him; he could not appear in the trial for a long; when he came back, he realized that Non Bailable Warrants have been issued against him; he himself appeared in the court and sought cancellation of Non Bailable Warrants, instead he was taken into custody. 4. Learned State Counsel admits that it is the applicant, who himself appeared before the court seeking cancellation of Non Bailable Warrants. 5. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 6. The bail application is allowed. 7. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
