Heard the parties.
2. The petitioner has been made accused in connection with S.T. Case No. 449/2024 arising out of Kunda P.S. Case No. 31/2024, for the offences registered under Sections 127(2), 103(1), 238/3(5) & 61(2) of the B.N.S. 2023, pending in the Court of learned A.S.J.-II, Chatra.
3. 02.07.2024, son of the informant left his house alongwith the co- accused persons. Thereafter, he went missing. Subsequently, his dead body was recovered.
4. It was submitted that apart from circumstantial evidence against the petitioner, there is no material available against him.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner and on specific quarry with regard to the recovery on pointing out of this petitioner, he has submitted that noting incriminating has been recovered on pointing out of this petitioner.
6. In view of the aforesaid facts, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned A.S.J.-II, Chatra in connection with S.T. Case No. 449/2024 arising out of Kunda P.S. Case No. 31/2024.
