Heard Learned Counsel, Mr. Debajit Biswas appearing on behalf of the accused-applicant. Also heard Learned P.P., Mr. Raju Datta appearing on behalf of the respondent-State. This bail application under Section 439 of the Code of Criminal Procedure, 1973 is filed for releasing the accused-applicant in custody in connection with Agartala GRPS case No.0008 of 2021 registered under Sections 21(c)/29 of NDPS Act, 1985 corresponding to Special NDPS 97 of 2024 pending before the Court of Learned Special Judge, Court No.4, West Tripura, Agartala. As ordered earlier, the record from the Learned Trial Court is received and also the Case Diary is produced by Learned P.P.

From the record it appears that initially one bail application bearing BA No.89 of 2024 was filed by the present accused-applicant before this Court prior to commencement of trial which was rejected vide order dated 18.12.2024. Further, from the record it appears that out of 19 numbers of witnesses as mentioned in the charge-sheet, 11 numbers of witnesses have already been examined and the next date of this case is fixed w.e.f. 11.09.2025 up to 18.09.2025 for recording evidence of the rest of the witnesses of the prosecution as per calendar. So, considering the nature and gravity of the offence at this stage there is no scope to consider the bail application of the accused- applicant. So, the present bail application accordingly stands rejected. The accused-applicant is to remain in J/C as before. However, Learned Trial Court shall make all endeavour to dispose of the case within a period of 4(four) months from the date of passing of this order. Further, Learned Trial Court shall take up the matter with the concerned Learned P.P. so that the presence of the witnesses is ensured on the dates fixed. Send down the record to the Learned Trial Court along with a copy of this order.
Return back the CD to the I.O. through Learned P.P. in course of the day. JUDGE
