For Petitioner : Mr.M.Guruprasad For Respondents : Mr.T.Balaji For Mr.D.Lakshmipathy For R.1 to R.5, R.8 to R.10 & R.11 ORDER Heard the learned counsel for the parties. 2, The revision petition has been filed challenging the return of an application, seeking amendment of the Lok Adalat Award dated 23.10.2024. 3. Mr.M.Guruprasad, learned counsel for the petitioner states that two inadvertent errors have crept i, the Award, which is passed, with the consent of all the parties. Pointing out the mistakes, learned counsel for the petitioner states that in the first page of the Award dated 23.10.2024, the petitioner has been described as “daughter” instead of “son” and in the 8th page, the running length of “31” feet has been inadvertently mentioned instead of “41 feet”. 2/6 https://www.mhc.tn.gov.in/judis C.R.P.No.4724 of 2024 4. Learned counsel for the respondents has no objection for the said mistakes being corrected. 5. The trial Court has returned the application only on the ground that the petition is not maintainable since the suit has been settled before the Lok Adalat. 6. This Court has held that the Civil Court has powers retained with itself to correct clerical errors or bonafide mistakes that creep in Lok Adalat Awards and merely because the parties settled the matter before the Lok Adalat, the Court is not without any power to correct any such clerical, arithmetical or bonafide errors that have been pointed out. 7. Admittedly both the mistakes appear to be inadvertent and not wanton. Further, learned counsel for the respondents has no objection for the corrections to be carried out in the Award, after suitable amendments are carried out in the plaint, where also the errors have originally occurred. 3/6 https://www.mhc.tn.gov.in/judis C.R.P.No.4724 of 2024 8. I do not see any lack of bonafides or any undue delay in seeking the modifications. Learned counsel for the respondents also has no objection that the application being allowed before this Court. 9. In the light of the above, the return dated 23.10.2024 on the file of II Additional District Court (FAC), Erode is set aside and the application in the unnumbered IA No.(CFR No.11290) of 2024 for carrying out amendment to the plaint and consequently in the Lok Adalat Award shall stand allowed. 10. Learned counsel for the petitioner shall carry out the necessary amendments in the plaint before the trial Court within a period of two weeks from the date of receipt of a copy of this order and based on the said amendments, the Court shall carry out suitable correction in the Lok Adalat Award and issue fresh copies to the parties. 11. It is also brought to my notice that the respondents 6 and 7 passed away and the legal heirs of the respondents 6 and 7 have already been impleaded in this revision. 4/6 https://www.mhc.tn.gov.in/judis C.R.P.No.4724 of 2024 12. With the above direction, the civil revision petition is allowed.
