Applicant has filed this application under Section 407 Cr.P.C. seeking transfer of Case No. 35425 of 2022, arising out of Case Crime No. 239 of 2022, under Sections 420, 406 I.P.C., Police Station Highway, District Mathura, pending before the Chief Judicial Magistrate, Mathura to the court of competent jurisdiction at Aligarh. Concededly, the applicant had launched the prosecution of the accused-opposite party nos.2 to 5 at Mathura and the trial is pending since 2022, who seeks transfer of the trial to Aligarh on the sole ground that she has now shifted to Aligarh. Since, the distance between two towns is approximately 45 kilometers, therefore, the sole ground raised for transfer of the case is not sufficient. The application is dismissed.
