At the outset, learned counsel for the respondents has submitted that when notice of motion was issued on 04.01.2023, it was so directed that the maintenance upto 09.07.2020 be paid to respondent No.1 but he has specific instructions to state that not even a single penny has been paid to respondent No.1 and even no maintenance has been paid to her upto 09.07.2020. He further submitted that almost two and a half years have elapsed and the maintenance has not been paid till date, therefore, in view of the above, the present petition may be dismissed. 2. Learned counsel for the petitioner submits that although he does not have instructions with regard to aforesaid position but believing the statement made by learned counsel for the respondents to be correct, it is the prime duty of the petitioner to pay the aforesaid balance of payment to POONAM NEGI 2025.07.17 15:44 I attest to the accuracy and integrity of this document CRR(F)-1382-2022 (O&M) -2- respondent No.1 atleast upto 09.07.2020 in compliance with the aforesaid order. 3. In view of the aforesaid facts and circumstances, this Court is of the considered view that since as per the statement made by learned counsel for the respondents, the petitioner has not made the payment even upto 09.07.2020, in compliance of order dated 04.01.2023, the petition is liable to be dismissed. 4. Consequently, the present petition is dismissed.
