Heard learned counsel for the petitioner and learned Standing Counsel for the State respondents. By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of mandamus to command respondent no. 1 to decide his pending application dated 25th January, 2024 seeking sanction to the criminal prosecution of police officers against whom complaint was entertained by the learned Magistrate converting 156(3) application into complaint and option was given to the petitioner to apply for appropriate sanction and further date was fixed. It is submitted that despite the fact that application was moved by the petitioner on 25th July, 2024, till date no order has been passed. In the given facts and circumstances of the case, we consider it appropriate to issue necessary direction to respondent no. 1 to pass order upon pending application of the petitioner dated 25th January, 2024 seeking sanction for criminal prosecution against Sub Inspector Saurabh Singh and Constable Shiv Kumar under various sections of erstwhile IPC regarding which complaint has been entertained by learned Magistrate and appropriate order shall be passing by the authority looking to the merits of the case, as expeditiously as possible positively within a period of one month from the date of presentation of certified copy of this order.
