Present petition under Section 528 BNSS, 2023, has been filed for quashing of order dated 13.08.2025 (Annexure P2) passed by learned trial Court in complaint case No.COMA-13 dated 23.02.2021, under Sections 29 read with Sections 3(k)(i), 17, 18, 29, 33 of Insecticide Act, 1968 and Rules 19(1) and 27(5) of Insecticide Rules, 1971, vide which on account of non-appearance, non-bailable warrants were issued against the petitioner. Brief facts, necessary for disposal of the present petition, are that the petitioner had been regularly appearing before the trial Court. However, on 13.08.2025, the petitioner was unable to appear before the trial Court and his bail order was cancelled and bail/ surety bonds were forfeited to the State and he was ordered to be summoned through non-bailable warrants. It has been contended by learned counsel for the petitioner that KOMAL 2025.09.23 17:40 I attest to the accuracy of this document CRM-M-52621-2025 (O&M) -2- the absence of the petitioner on 13.08.2025 was not intentional rather for the reason that the petitioner was taking care of his ailing mother, due to which he could not appear before the trial Court on the aforesaid date. He further submitted that now the matter is fixed for 03.10.2025 before learned trial Court and the petitioner is ready to surrender before the trial Court and requested that the impugned order dated 13.08.2025 be set aside. Heard. Considering the facts and circumstances of the present case and to enable the petitioner to join the proceedings pending before the trial Court and to expedite the proceedings in trial, the impugned order dated 13.08.2025 is set aside. The petitioner is directed to surrender and appear before the learned trial Court within 10 days and on doing so, he would be released on bail on furnishing his fresh bail/surety bonds to the satisfaction of the Court concerned and with the undertaking to appear regularly before the trial Court on each and every date of hearing and subject to depositing of Rs.4,000/- with DLSA, Tarn Taran.
