The instant writ petition has been filed for following relief: " It is, therefore, most respectfully prayed that this Hon'ble Court may kindly be pleased to direct the Civil Judge (Junior Division) Bansgaon, District Gorakhpur to decide the Misc. Case No. 197 of 2025 (Smt. Amina Khatoon Vs. Shahid Ahmad and others) filed under Order 39 Rule 2A of C.P.C. arising out of O.S. No. 1205 of 2009 (Smt. Amina Khatoon Vs. Sharif and others) within some stipulated period as may be fixed by this Hon'ble Court, otherwise the plaintiff-petitioner shall suffer irreparable loss and injury. And/Or pass such other and further order which this Hon'ble Court may deem fit and proper under the circumstances of the present case." 3. Contention of the learned counsel for the petitioner is that an application under Order XXXIX Rule 2A is pending since 2009 and the same has not been decided despite several dates have been fixed. He prayed that the same may be decided, expeditiously. 4. In view of above, no useful purpose would be served in keeping this petition pending. 5. Accordingly, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division) Bansgaon, District Gorakhpur to consider and decide the aforementioned application in accordance with law, expeditiously, preferably within a period of six months from the date of Versus Counsel for Petitioner(s) : Dharmendra Kumar Shukla Counsel for Respondent(s) : Smt.
