The prayer in the present petition under Section 483 BNSS is for grant of the grant of regular bail to the petitioner in case FIR No.88 dated 06.05.2025 registered under Sections 109, 132, 221, 190, 121 and 238 BNS, 2023 at Police Station Talwandi Sabo, Bathinda. . 2. The present FIR came to be registered at the instance of Constable Jagsir Singh and reads as under:-
“Copy of statement, "Statement of Senior Constable Jagsir. Singli No. 5C/565 Anti-Narcotics Task Force, Bathinda Range, Bathinda aged about 36 years, Mob. No. 97800-02588, stated that I am posted in Police. Department, Anti-Narcotics Cell Task Force, Bathinda Range, Bathinda. Today, Incharge of our Narcotics Task Force ASI Major Singh 69/Mansa, HC Kulvir Singh 2/48 IRB HC Rajinder Singh, Constable Jagsir Singh SCT Mann Singh for checking of suspected persons and vehicles w.rt.

CRM-M-52149-2025 -2- Worker namely Ram Singh son of Jagga Singh resident of Gurtlari, PS: Sangat met with Incharge Major Singh and some information was gathered and we after making the parties, started to keep eye upon two cars one Swift and one Honda City Amaze, the numbers of which are not known, as per information the Honda City Amaze car is being driven by Jassa Singh resident of Singhpura Haryana and with whom there are Gurpiar Singh Geeta Singh and Jashanpreet Singh @ Lassi, both are brothers residents of Talwandi Sabo and Harpreet Singh @ Kali son of Jagtar Singh resident of Talwandi Sabo is also with them, they are engaged in the business of drugs and in Swift car, the 4/5 friends of above said persons are wandering, then at about 12:30 PM that one team was present at Singhpura Road Teona Pujaria, then one car Amaze Honda City came from the side of City Singhpura and ASI Major Singh tried to stop it, then the passengers of the car with the intention to kill us turned the car straight towards us, then we with great efforts after turning aside saved our lives after running from there. I am ASI Major Singh along with Police party were moving towards one side for our safety, then they after stopping the car and after alightening from the car started to pelt stones towards us and ASI Major Singh and Social Worker Ram Singh suffered grievous head injuries and I also suffered serious injuries. All the above said after giving us injuries fled away from the spot on their car above said. Then our other companions got us admitted in Civil Hospital, Talwandi Sabo for the treatment. The above said persons were having arms weapons with them. They have obstructed in our duty. The appropriate action may kindly be taken against them.

The learned counsel for the petitioners contends that the petitioners have been falsely implicated in the present case. CRM-M-52149-2025 -3- injured. Pursuant to the arrest of the petitioners no recovery has been effected from them. As they are in custody since 06.05.2025 and 07.05.2025 respectively but none of the 14 prosecution witnesses has been examined so far, the trial of the present case is not likely to be concluded anytime soon and therefore, they are entitled to the concession of bail, moreso when their co-accused, namely, Harpreet Singh @ Kali and Jaswant Singh @ Jassa Singh have been granted the concession of bail vide orders dated 25.08.2025 & 01.09.2025 (Annexures P-3 & P-4). 4. The learned counsel for the State on the other hand contends that keeping in view the allegations levelled against the petitioners, they are not entitled to the concession as prayed for. He, however concedes that the petitioners are in custody since 06.05.2025 and 07.05.2025 respectively and that none of the 14 has been examined so far. 5. I have heard the learned counsel for the parties. 6. The veracity of the prosecution case against the petitioners and their co-accused shall be adjudicated upon during the course of the trial. Admittedly, the petitioners are stated to be in custody since 06.05.2025 and 07.05.2025 respectively but none of the 14 prosecution witnesses has been examined so far. Therefore, their further incarceration is not required moreso when their co-accused, namely, Harpreet Singh @ Kali and Jaswant Singh @ Jassa Singh have been granted the concession of bail vide orders dated 25.08.2025 & 01.09.2025 (Annexures P-3 & P-4). 7.
Thus without commenting on the merits of the case, the present petition is allowed and the petitioners are ordered to be released on bail JITESH LAL 2025.09.22 18:36 I attest to the accuracy and integrity of this document
CRM-M-52149-2025 -4- subject to their furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 8. The petitioners (or anyone on their behalf) shall prepare an FDR in the sum of Rs.25,000/- each and deposit the same with the Trial Court. The same would be liable to be forfeited as per law in case of the absence of the petitioner from trial without sufficient cause. 9. The petition stands disposed of.
