The present application has been filed with prayer to quash the non bailable warrant dated 20.07.2024 as well as the entire proceedings of Session Trial No.- 495 of 2013 (State Vs. Zishan and others) arising out of Case Crime No.- 69 of 2012, under Sections 302, 393 I.P.C., P.S.- Rajghat, District- Gorakhpur pending in the Court of learned Additional District Judge-II, Gorakhpur. 3. Learned counsel for the applicant confines his argument that a direction be issued to learned court concerned for cancellation of N.B.W. and grant of bail as expeditiously as possible. 4. Learned A.G.A. has no objection to the above submission. 5. In view of above, if the applicant surrenders before court concerned within five weeks from today and applies for cancellation of N.B.W. or grant of bail, the same shall be considered and decided by learned court concerned in accordance with law as expeditiously as possible.
