(ORAL) Petitioner has challenged the order dated 25.08.2025 (Annexure P-1) passed by learned Additional Civil Judge (Senior Division), Panchkula whereby evidence of plaintiff-petitioner was closed by Court order. Learned counsel for the petitioner has fairly submitted that as many as 11 opportunities were granted to plaintiff. He, however stated that plaintiff was bed-ridden since December 2024 and therefore, could not come present in the Court to adduce his evidence. He requests that he be granted two opportunities to conclude his evidence. Keeping in view the facts and circumstances of the present case, I feel it appropriate to grant one effective opportunity to the petitioner- plaintiff to conclude his entire evidence. The learned Court below is requested to allow to examine the plaintiff and to summon witness/record from HUDA. The next date before the trial Court is 22.09.2025. Accordingly, on 22.09.2025 the learned Court of First Instance JANKI BHATT 2025.09.19 19:04 I attest to the accuracy and integrity of this document High Court Chandigarh CR-6634-2025 (O&M) -2- is directed to fix date giving minimum 20 days to the petitioner allowing him to take dasti notices of all the witnesses he wants to examine. It is made clear that in case service is not got effected and dasti notices are not placed on record with the service report, no further opportunity would be granted. However, in case a witness from HUDA is served but he fails to appear despite service, Court shall ensure presence of said witness through process of Court. Petitioner shall be entitled to only one effective opportunity in above-noted manner, subject to payment of Rs.20,000/- as costs which shall be deposited on or before 22.09.2025.
