The present petition has been filed under Articles 226/227 of the Constitution of India for challenging the order dated 13.06.2025 passed by the Licensing Authority-cum-District Controller, Food, Civil Supplies & Consumer Affairs, Ludhiana West (Annexure P-4) vide which the depot licence of the petitioner has been suspended by the aforesaid authority. 2. Learned counsel for the petitioner has submitted that although an appeal/representation was filed against the aforesaid order but there is no provision of appeal as per Clause 17 of the Punjab Targeted Public Distribution (Licensing & Control) Order, 2016. He further submitted that so far as the order of suspension is concerned, the same was passed without affording an opportunity of hearing while issuance of show cause notice to the petitioner and therefore, the maximum period under Clause 15 of the Punjab Targeted Public Distribution (Licensing & Control) Order, 2016 was 90 days only and since the present order has been passed without issuing show cause notice and opportunity of hearing, the maximum period of 90 BHUMIKA BHATI 2025.09.19 15:02 I attest to the accuracy and integrity of this document chandigarh CWP-27630-2025 -2- days has already expired on 10.09.2025 and therefore, he may be permitted to withdraw the present petition in order to enable the petitioner to file an application before the concerned authority for passing an order for restoration of food supplies to the depot of the petitioner. 3. The prayer made by learned counsel for the petitioner is accepted. 4. The present petition is dismissed as withdrawn. 5. Liberty is granted to the petitioner to move any appropriate application before the concerned authority for redressal of the aforesaid grievance.
