This writ petition has been filed with the following prayer:- "a) issue a Writ, Order or direction in the nature of mandamus commanding and directing the Respondent no.2/Sub-Divisional, Tehsil-Hata, Magistrate, District- Kushinagar to decide the Case No. 48 of 2013 (Bramhadev and others Vs. Kishun Dayal and others) filed under section 176 of Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950, pending before the respondent no.2/Sub-Divisional, Tehsil- Hata, Magistrate, District-Kushinagar, within stipulated time period as fixed by this Hon'ble Court." 2. It is contended by learned counsel for the petitioner that a suit in proceedings under Section 176 of the U.P.Z.A. and L.R. Act is pending consideration before the respondent no. 2. The sole prayer made is for expeditious disposal of the same. 3. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, without calling for counter affidavit, with a direction to the respondent no. 2- Sub-Divisional Magistrate, Tehsil Hata, District Kushingar to decide the Case No. 48 of 2013 (Bramhadev and others Vs. Kishun Dayal and others) under section 176 of the U.P.Z.A. and L.R. Act, in accordance with law, after hearing all affected parties, preferably within a period of six months from the date of production of certified copy of this order. 4. With the aforesaid directions, writ petition stands disposed of. 5. It is made clear that this Court has not adjudicated the matter on merits. September 25, 2025 A. V.
