Petition has been filed for restoration of the case bearing M.A. No. 389 of 2014 to its original file, which was dismissed for default on 23.02.2021, due to non-compliance of the peremptory order dated 09.02.2021. From perusal of the records of the case, it appears that there was a peremptory order for removal of the defects and for its non-compliance, the miscellaneous appeal was dismissed. Learned counsel undertakes to remove the said defect(s) within four weeks after restoration. Considering the grounds taken, this Civil Misc. Petition is allowed and M.A. No. 389 of 2014 is restored to its original file. Learned counsel for the petitioner is directed to deposit the statuary amount within a period of four weeks, failing which M.A. No. 389 of 2014 shall stand dismissed without further reference to the Bench.
