JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 13-10-2025 Heard learned counsel for the petitioners and the State. 2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 332, 333, 353, 427, 307, 120(B), 337, 338, 506 of Indian Penal Code and Section ¾ of Damage of Public Property Act. 3. The prosecution case in brief, is that these petitioners were members of mob who along with other co- accused persons were protesting against the Agnipath Scheme of the government. It further alleged that after sometime, the protesters became aggressive and started damaging the vehicles Patna High Court CR. MISC. No.71828 of 2025(2) dt.13-10-2025 2/3 present there, vandalized the police vehicle and set most of the vehicles on fire. It is further alleged that protesters also threw bricks and stones on the police force due to which some of the the police personnel sustained severe injuries. 4. It is submitted on behalf of the petitioners that petitioners are not named in the F.I.R. Names of these petitioners transpired during course of investigation on confessional statement of other co-accused persons. Allegation is general and omnibus against these petitioners. Petitioners claim clean antecedent. Similarly situated co-accused persons have already been granted anticipatory bail by co-ordinate Bench of this Hon’ble Court vide order dated 29.07.2025 in Cr. Misc. No. 50387 of 2025. 5. Learned A.P.P. for the State vehemently opposed the bail application. 6. Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Patna High Court CR. MISC. No.71828 of 2025(2) dt.13-10-2025 3/3 Magistrate-V, Danapur in connection with Khagaul P.S.
