1. This CRLMP has been filed seeking a direction to the Inspector in-charge of Baranga Police Station, opposite party No.4 to register the F.I.R. and to investigate the matter properly for the greater interest of justice.
2. It is averred in the petition that the petitioner reported the matter on 11/12.11.2025 before the Inspector in-charge of Baranga
Police Station on the allegation that the petitioner had given Rs.12,60,000/- (Rupees twelve lakhs sixty thousand) in cash to the accused persons for purchase of a piece of land. The accused persons thereafter had demanded Rs.2,50,000/- (Rupees two lakhs fifty thousand) for execution of sale deed. Since the accused persons did not execute the sale deed nor returned the money, the petitioner submitted the complaint against the accused persons in Baranga police station.
3. It has been averred in the CRLMA that the complaint had been given on 11-12/11.2025, which is vague.
4. Mr. S.K. Rout, learned Addl. Standing Counsel submitted that there is no material on record that the F.I.R. in question had been sent to IIC, Baranga Police Station.
5. Representation dated 14.12.2025 had been sent to the D.C.P., Cuttack on 15.12.2025 by speed post.
6. After hearing the learned counsel for the respective parties and perusing the materials on record, this CRLMP is disposed of with the observation that if a complaint discloses commission of any cognizable offence, it is the duty of the police to register a case.
7. If a case has not been registered, it is open to the petitioner to avail the alternative remedy available to him in view of the decision of the Hon’ble Supreme Court in the case of Sudhir Bhaskarrao Vs. Hemant Yashwant Dhage and others reported in (2016) 6 Supreme Court Cases 277.
8. With these observations, the CRLMP is disposed of.
9. Issue urgent certified copy as per Rules.
