1. Both the applicants i.e., Razzak & Aman seek anticipatory bail in case FIR No. 168/2025 registered at P.S. Nangloi for commission of offences u/s 324(2)/115(2)/118(1)/109/3(5) Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 426/323/324/307/34 IPC)
2. The above said FIR was registered on the basis of complaint made by one Mr. Deepak Singh, who was running an office in the name of M/s Bajrang Properties & Finance. He alleged that on 16.04.2025, the accused persons came on motorcycles and started hurling stones at his office. The accused This is a digitally signed order. persons also trespassed into the office with dandas and stones and caused injuries to him and his friends who were present in the office.

Learned APP for the State, on the basis of the instructions received from the IO, who is also present in Court today, submits that the investigation is already over and the chargesheet has though been laid before the concerned Magisterial Court, the cognizance is yet not taken and, as per the investigation, there are 5 accused persons and 2 such accused persons i.e, accused Razzak and Aman have been shown in column no. 12 for the reason that they are on interim bail.

It needs to be highlighted that, when the anticipatory bail application of accused-Razzak was taken up by the learned predecessor Bench on 03.07.2025, keeping in mind the overall facts of the case, he was directed to join the investigation and it was also observed that no coercive action be taken against him till further orders. Such order continues to be in operation and learned APP submits that as per information given by IO, he has joined the investigation.

Learned counsel for the applicant strongly relies upon order dated 26.11.2025 passed by learned coordinate bench in BAIL APPLN.-3818/2025 whereby anticipatory bail has been granted to one other co-accused Sh. Nikhil Sharma, who is also named in the FIR. It is submitted that the allegations against all the accused persons are almost identical and, since the investigation is already over and, since the chargesheet has also been filed, both the present applicants also deserve to be released on anticipatory bail.
6. Copy of the above said order dated 26.11.2025 passed in BAIL APPLN.-3818/2025 is taken on record.

while applying the principle of parity, the present two applications are
disposed with the direction that in the event of their arrest, the investigating officer/arresting officer would release them on bail on their furnishing personal bond and surety bond in a sum of Rs. 20,000/- each. However, they shall not come in contact with any of the prosecution witnesses in any manner whatsoever, directly or indirectly.
8. A copy of this order be sent to concerned SHO/IO for information and compliance.
