JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 13-10-2025 Heard learned counsel for the petitioners and the State . 2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 191 ( 2 ), 326 ( b ), 115 ( 2 ), 109, 74, 303 ( 2 ), 352 and 351 ( 2 ) of the BNS. 3 . As per the prosecution case , informant namely , Devanti devi alleged that all the F.I.R. named accused persons including these petitioners assaulted husband of informant with lathi and danda and when informant went to save him , she was also assaulted by accused persons. It is further alleged that Patna High Court CR. MISC. No.71524 of 2025(2) dt.13-10-2025 2/2 accused persons looted informant. 4. It is submitted on behalf of the petitioners that petitioner and informant are neighbour and due to dispute over disposal of house wastage , a maarpeet in which both sides sustained injuries. Case and counter case . Allegation of assault is general and omnibus against these petitioners. 5 . Learned counsel for the State oppose the bail petition . 6 Considering the general and omnibus allegation of assault against these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM Danapur District- Patna in connection with Shahpur P.S. Case No. 226 of 2025 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 . Koushik/- (Prabhat Kumar Singh, J) U T
