JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 13-10-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. 2. Petitioners apprehend their arrest in connection with Chandi P.S. Case No.159 of 2019, registered for the offence under Sections 30(a), 30(d) of the Bihar Prohibition and Excise Act, 2016 and Sections 272, 273/34 of the Indian Penal Code. 3. As per prosecution case, total 1000 liters Java Mahua, 30 liters country made mahua liquor as well as equipment meant for preparing liquor from near Kumhari river. It is alleged that on seeing the police party, 10-12 persons started fleeing away and succeeded in fleeing away taking

On query, neighbours disclosed their names, which includes petitioners, who were engaged in preparing liquor. 4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Petitioners were not apprehended on the spot and due to village politics and enmity, petitioners were made accused. Similarly situated co-accused persons have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 15.11.2019 passed in Cr. Misc. No. 68170 of 2019. Petitioners have no criminal antecedent. Petitioners undertake to cooperate in the investigation and trial of this case. 5. Learned APP opposes the prayer for anticipatory bail of the petitioners. 6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.
10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge-cum-Special Judge, Excise,
