HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34058 of 2025 Court No. - 4 HON'BLE AJIT KUMAR, J.
HON'BLE SWARUPAMA CHATURVEDI, J. Heard Mr. Sanjeev Singh, learned counsel for the petitioner and Ms. Vatsala, learned panel counsel appearing for respondent bank. By means of present petition filed under Article 226 of the Constitution, petitioners are aggrieved by the order passed by the Chief Manager of the Bank of India- Bulandshahar Raod Industrial Area Branch, Ghaziabad dated 17.5.2025 freezing the account of the partnership firm of the petitioners only upon complaint being made by erstwhile partners of the firm that modified partnership deed dated 1st April, 2016 was fake one and also bore fake signatures. It is contended by learned counsel for the petitioner that since account of firm was being operated since 2016 before passing the order to freeze the account, the bank ought to have been given notice to the petitioner in the nature of show cause of the petitioner. Ms. Vatsala, learned counsel for the bank on the contrary states that though transaction from the account has been stopped but account has not been freezed and if petitioners have been asked to furnish details to clarify qua complaint made against them, the Bank will certainly be passing appropriate order. In view of above, we dispose of this petition with a direction to the petitioners in the first instance to submit thier reply to the bank by the 13th October, 2025, and thereafter, the bank will examine the records placed before it and will pass appropriate order within next two days. The order passed by the Chief Manager of the bank dated 17.5.2025 shall abide by decision to be taken by the Chief Manager of the bank afresh .
