1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offences punishable u/s 191(2), 192(3), 190, 126(2), 115(2), 118(1), 109, 329(4) and 352 of BNS, 2023. 3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on account of a dispute relating to past elopment, seven named accused including the petitioner came on 26.05.2025 at 10:00 A.M. and Sukradeo Sharma and Manik Sharma assaulted Sanjha Devi by spade causing injury on head. 4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the
Patna High Court CR. MISC. No.71144 of 2025(2) dt.13-10-2025 2/3 informant. It is next submitted that brother of the informant Prakash Sharma was married Najni Devi, daughter of Basant Sharma about three years back but Manik eloped with Najni about two months back and married her for which a panchayati was held, further, when Najni became pregnant Manik disowned her but she was brought back. Learned counsel for the petitioner submits that from perusal of the allegation made in the F.I.R., it would manifest that no specific allegation of assault is alleged against the petitioner though the name of this petitioner rhymes with the name of Sukradeo Sharma. It is next submitted that petitioner is not a criminal. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner. 6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.
10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kadwa P.S. Case No. 115 of 2025 subject to the conditions as laid down under
Patna High Court CR. MISC. No.71144 of 2025(2) dt.13-10-2025 3/3 Section 482 (2) of BNSS. 7. Accordingly, the instant anticipatory bail application stands allowed. pallavi/- (Satyavrat Verma, J) U T
