2. The learned counsel for the petitioner would submit that though the respondent had not denied the issuance of the cheque, the trial Court erroneously held that the petitioner had not established that a cheque was issued for a legally enforceable debt; and that therefore, the judgment of the trial Court is liable to set aside.
3. The learned counsel for the respondent would submit that the
judgment of the trial Court need not be interfered with.
4. The points raised by the petitioner require consideration by this Court and hence, leave is granted to file an appeal.
