JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 2 13-10-2025 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner has preferred this application for grant of regular bail in connection with Ramgharwa P.S. Case No. 202 of 2025 dated 18.06.2025 registered for the offences punishable u/ss 191(2), 191(3), 126(2), 115(2), 118(1), 109, 74, 303(2), 352, 351(2) of the BNS. 3. As per the prosecution case, when the informant along with the other family members was ploughing the field from the tractor, in the meantime, the petitioner and the co- accused persons armed with various weapons came there and stopped them. No.64521 of 2025(2) dt.13-10-2025 2/3 on the exhortation of the co-accused Ekram Miyaan, the other co-accused Sheikh Adbullah assaulted the niece of the informant with Farsa on her head with intention to kill causing severe injury to her and blood started oozing out. It is further alleged that the co-accused Sheikh Laddu also assaulted the informant with sword on his head with intention to kill causing severe injury and the other co-accused persons also assaulted them indiscriminately. When the informant’s family member came to rescue, the other co-accused persons also assaulted them with lathi and the petitioner and the other co-accused persons threatened to kill them. It is further alleged that the co-accused, Junaid also snatched golden chain worth Rs. 1.5 lakhs from the neck of his niece. 4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The allegation against the petitioner is only of threatening. The petitioner has one criminal antecedent as stated in para 3 of the bail petition.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above- named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Ramgharwa P.S.
