JUSTICE ARUN KUMAR JHA ORAL ORDER 2 08-10-2025 Since all these bail petitions arise out of Buxar Rail P.S. Case No. 187 of 2025, as such, they have been taken up together and are being disposed of by this common order. 2. Heard learned counsel for the petitioners and learned APP for the State. 3. In the present cases, the petitioners seek bail in connection with Buxar Rail P.S. Case No. 187 of 2025, registered for the offence under Section 30 (a) of Bihar Prohibition and Excise Act. 4. As per prosecution case, on suspicion, police conducted a raid in the compartment of a train and recovery of total 348 liters of illicit liquor was made and the petitioners were apprehended from the said compartment of the train. 5. It has been submitted on behalf of the petitioners that the petitioners are innocent and have been arrested on the basis of suspicion. The petitioners were just sitting in the compartment and they have no concern with the seized liquor. Nothing incriminating has been recovered from the person/possession of the petitioners. Learned APP opposes the submission made on behalf of the petitioners. 7. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the vague nature of allegation and further considering the period of custody of the petitioners along with their clean antecedents, the petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, Bhojpur at Ara/concerned court, in connection with, Buxar Rail P.S. Case No. 187 of 2025, subject to the conditions mentioned in Section 480 (3) of BNSS and also the following conditions : (i) One of the bailors will be the close relative of the petitioners. (ii) The petitioners will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled Patna High Court CR. MISC.
