JUSTICE R.K. PATTANAIK Order No. ORDER 21.01.2025 01. 1. Heard Mr. Panda, learned counsel for the petitioner and Mr. Mohanty, learned ASC for the State. 2. Instant petition under Section 483 BNSS is filed for release of the petitioner on bail in connection with T.R. Case No.2 of 2025 pending in the file of learned Additional Sessions Judge-cum-Special Judge, Koraput corresponding to Nandapur Excise P.R. No.175 of 2024-25 on the grounds stated therein. 3. Perused the P.R. as at Annexure-1 and rejection order i.e. Annexure-2. 4. Mr. Panda, learned counsel for the petitioner submits that the present accused is in no way involved in the case. Since 10 Kgs of contraband Ganja is seized and recovered from the possession of the petitioner, he should be allowed to go on bail as further submitted. p. 2 5. A formal objection is received from Mr. Mohanty, learned ASC for the State. 6. Gone through the P.R. as at Annexure-1 and the Court finds that such recovery is made from the exclusive possession of the petitioner. However, recording the submission of learned counsel for the petitioner that the petitioner has no other criminal antecedent of similar nature, this Court is inclined to release the petitioner on bail subject to following conditions. 7. Hence, it is ordered. 8. In the result, petition under Section 483 BNSS stands allowed. Consequently, the petitioner is directed to be released on bail in connection with T.R. Case No.2 of 2025 corresponding to Nandapur Excise P.R. No.175 of 2024-25 subject to him furnishing a bail bond of Rs.20,000/-(Rupees twenty thousand) with one solvent surety for the like amount to the satisfaction of learned Additional Sessions Judge-cum-Special Judge, Koraput, who shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 9.
