ORDER Date : 04.04.2025 Heard Mr. R. Boruah, learned counsel for the applicant. Also heard Mr. S. P. Sharma, learned counsel for the Opposite Party No.1 and Mr. P. Daimary,
learned counsel for the Opposite Party Nos. 2 & 3. This interlocutory application under Section 151 of the Code of Civil Procedure, 1908, is preferred by the applicant, for allowing him to withdraw a sum of Rs. 8,25,738/- being deposited before the Registry of this Court by the respondent No.1, i.e. the Oriental Insurance Company Ltd. Mr. Boruah, learned counsel for the applicant submits that pursuant to an
order dated 12.02.2025, passed by this Court in I.A. (C) No. 64/2025, the respondent/Insurance Company has deposited 50% of the awarded amount, i.e. Rs. 8,25,738/-, before the Registry of this Court and the applicant may be allow to withdraw the aforesaid amount. Mr. Sharma, learned counsel for the Opposite Party No.1 submits that he has no objection in the event of allowing this application. Taking note of the submission of learned counsel for both the parties this I.A. (Civil) No. 924/2025 is allowed. The applicant is allowed to withdraw a sum of Rs. 8,25,738/- deposited
Page No.# 4/4 before the Registry of this Court. In terms of above, this I.A. Stands closed.
