JUSTICE SATYAVRAT VERMA ORAL ORDER 2 14-10-2025 1. Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail in anticipation of her arrest in a case registered for the offences punishable under Sections 115(2), 109, 126(2), 308(2), 191, 190 of the B.N.S. 3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is a woman and the informant alleges that accused persons including the petitioner along with 10-12 unknown accused came while informant and her family members were constructing their hut and started assaulting by lathi indiscriminately. Further, Amar assaulted her husband by lathi causing injury on head, thereafter Vijay assaulted her son by lathi causing injury on head while Chhote Lal assaulted Shyamsunder by lathi causing injury on Patna High Court CR. MISC. No.72037 of 2025(2) dt.14-10-2025 2/3 head and Tapan assaulted Sriram by lathi causing injury on head, thereafter police was informed and police took the injured to the hospital. 4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that no specific allegation of assault is alleged against the petitioner. It is also submitted that since petitioner is wife of Chhote Lal as such, she came to be implicated with a view to coerce him into submission. 5. Learned A.P.P. Sri Rabindra Kumar opposes the anticipatory bail application. 6. Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of her arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on her furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Bagaha, West Champaran in connection with Bhairoganj P. S. Case No.72 of 2025, subject to the Patna High Court CR. MISC. No.72037 of 2025(2) dt.14-10-2025 3/3 conditions laid down under Section 482(2) of the BNSS. 7.
