Heard learned Counsel Mr. A.K.Talukdar for the petitioners 1. Abdul Hannan Choudhury and 2. Jahidul Alom Choudhury who have filed this application under Section 483 of the BNSS, 2023 with a prayer for bail as they are behind bars since 17.03.2025 in connection with Karimganj PS Case No. 135/2025 under Sections 117(2)/115(2)/351 of the BNS. 2. Learned Addl.Public Prosecutor Ms. N.Das is present for the respondent State. 3. It is submitted on behalf of the petitioners that a fight broke out between the parties when a cow entered into the informant’s premises by breaking the bamboo fence. It is submitted that the fight was between both the sides and finally an affidavit has been submitted by the informant Bakkar Ali Laskar and Sajid Laskar which is marked as Annexure- E of the petition wherein it has been stated that the informant has no objection if the petitioners are enlarged on bail. 4. Considering all the aspects, the prayer for bail is allowed. 5. The petitioners named above shall be released on bail on furnishing bail bond of Rs.50,000/- each with a suitable surety each of like amount to the satisfaction of the learned CJM, Karimganj subject to the following conditions: i) The petitioners shall co-operate with the investigation and shall not exercise any threats to the witness, Page No.# 3/3 ii) The petitioners shall appear before the I.O. every fortnight till completion of the investigation, iii) The petitioners shall refrain from committing any such activities of which they are alleged. 6. On breach of any of the above conditions, learned court is at liberty to immediately cancel bail granted to the petitioner. 7.
