The petitioner has been made accused in connection with Deoghar (Cyber) P.S. Case No.11 of 2025 registered under Section 319(2), 318(4), 338, 336(3), 340(2) and 61 of the B.N.S., 2023 and Section 66(B), 66(C), 66 (D) and 84(C) of the Information Technology Act. Learned counsel for the petitioner files a supplementary affidavit. Let the same be kept in the record. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in cybercrime and he has defrauded the victim Digamber Yadav to the tune of Rs.41,300/- and Ramesh Kumar to the tune of Rs.1500/-. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in para-15 of this bail application. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will transfer the respective amounts allegedly defrauded from the bank account of the said victims. It is lastly submitted that the petitioner has been in custody since 25.01.2025 as is evident from para-16 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Spl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on showing proof of transferring Rs.41,300/- and Rs.1500/- respectively in the account of Digamber Yadav and Ramesh Kumar and on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Deoghar in connection with Deoghar (Cyber) P.S. Case No.11 of 2025 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case.
