JUSTICE S. B. PD. SINGH ORAL ORDER 2 13-10-2025 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. 2. The petitioner seeks bail in connection with Rajauli P.S. Case No. 199/2025 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 3. As per the prosecution case, the police got secret information that the petitioner along with other accused persons were indulged in selling of illicit liquor in Jamundaha forest. When the police conducted raid, some persons fled away and 300 litres of country-made Mahua and three bikes were recovered. 4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the Patna High Court CR. MISC. No.72122 of 2025(2) dt.13-10-2025 2/2 present case. Learned counsel further submits that the alleged desi mahua was recovered from a forest area which is an open place and petitioner has no concern with the three bikes which were seized. Learned counsel further submits that petitioner is in custody since 27.08.2025. 5. Learned APP for the State has opposed the prayer for regular bail of the petitioner. 6. Considering the facts and circumstances of the case, this application for regular bail is allowed. 7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of Exclusive Special Excise Court-II, Nawada in connection with Rajauli P.S.
