HIGH COURT OF JUDICATURE AT ALLAHABAD WRIT - C No. - 34246 of 2025 Court No. - 32 HON'BLE SAURABH SHYAM SHAMSHERY, J. 1. Heard Sri Prabhakar Awasthi, learned counsel for petitioner, Sri Vaibhav Tripathi, learned Standing Counsel for State and Sri A.K. Yadav, learned counsel for respondent- University. 2. Petitioners before this Court are a law college imparting education of LLB and LLM courses. Initially, 20 seats were sanctioned to petitioner-college for imparting LLM Course by the concerned University and after due verification and procedure, by an order dated 16.10.2021, 40 seats were increased i.e. total 60 seats were sanctioned for LLM Course and accordingly, intake was taken. 3. After about four years, by an ex-parte order dated 30.05.2025, order of increment of 40 seats was withdrawn on a ground that petitioner institution is not valuated by National Assessment and Accreditation Council (NAAC) and it is further observed in impugned order that said institution may undertake NAAC valuation. 4. Learned counsel for petitioner refers paragraph 25 of writ petition that presently respondents are not granting certificate of NAAC, therefore, petitioner - college becomes remediless since at this stage, no such valuation can be done, though in support of his submissions, no document is placed on record. The NAAC is also not a party respondent in this writ petition, therefore, learned Versus Counsel for Petitioner(s) : Prabhakar Awasthi, Saurabh Tripathi Counsel for Respondent(s) : Ashok Kumar Yadav, C.S.C. Shri Krishna College Of Law And Another .....Petitioner(s) State Of U.P. And 2 Others .....Respondent(s) Standing Counsel and learned counsel for University are not in a position to make any statement. 5. In view of above, this writ petition is disposed of with an observation that in case petitioner moves an application before NAAC within 1 week from today, said Council will conduct inspection to grant certificate and in case there is any legal impediment or presently, no such certificate could be passed, the same shall be communicated to petitioner - college within 10 days thereafter so that petitioner - college may confront with respondents that condition prescribed in impugned order cannot be satisfied which could be a reason to revisit the impugned order within 2 weeks thereafter.
